Ark Medical — Terms of Use

Effective 27 September 2026

1. What Ark provides

Ark Medical is a medical information workspace for research, education and evaluation. It uses artificial intelligence and literature retrieval to discuss clinical narratives, explain possible diagnoses, identify questions and alternatives, and present treatment information with supporting references where available.

These terms cover the Ark Medical beta at arkmedical.net. They apply when you accept them through Ark's sign-in or account process.

2. Clinical responsibility

Ark's output can be incomplete, inaccurate or out of date. A citation does not guarantee that a statement is correct or applicable to a particular patient. A confident answer, a provisional diagnosis or a treatment suggestion is not a confirmed clinical finding.

You must independently assess important claims, read the relevant sources, consider the full clinical context and use appropriate professional or specialist judgement. Check medicines, doses, contraindications, interactions and local guidance before any clinical use. Ark does not provide a clinician–patient relationship, emergency care or continuous monitoring. Do not delay necessary assessment or treatment while waiting for a response.

3. Accounts and beta access

Use accurate account information and keep your account secure. Do not share your login or allow another person to use your account. Contact us promptly if you suspect unauthorised access.

Beta access is arranged individually. Email the address you will use to sign in to davidmdtran@gmail.com so that your beta access can be set up without going through payment. If a payment screen appears unexpectedly, contact us before entering payment details.

Approved beta access does not automatically enrol you in a paid subscription. Any later paid plan must show its price, billing period and cancellation conditions before you choose it. These terms do not authorise a future charge or change an existing paid agreement.

4. Information you submit

Use fictional or appropriately de-identified clinical material during the beta. Do not submit patient names, full dates of birth, record numbers, addresses, contact details, recognisable photographs or other information that could reasonably identify someone. Rare combinations of facts, exact dates, document metadata and recorded voices can also identify people. Removing a name alone may not be sufficient.

You are responsible for checking text, images, documents and audio before submitting them, and for following your professional duties and your organisation's rules. Do not assume that Ark automatically removes identifiers. Use of the service does not replace any permission or legal basis you need for handling someone else's information.

You retain your rights in material you submit. You give Ark the limited permission needed to process it, provide requested features, store saved conversations and account memory, and use service providers for those purposes as explained in the Privacy Policy. This is not a general transfer of ownership of your material.

If identifiable or confidential information is submitted by mistake, stop further sharing and contact us promptly. Do not include the sensitive information again in the initial email.

5. Saved material and privacy

Saved conversations and account memory can persist after you leave the page. Some preferences and content are also held in your browser. Signing out, clearing a browser or revoking Google access does not by itself delete information already stored by Ark.

The Privacy Policy explains account information, case processing, external services, storage and deletion requests. Keep any clinical record that your duties require in your organisation's approved record system. Ark is not a substitute for that system or for your own necessary records.

6. Appropriate use

Do not use Ark unlawfully, infringe another person's rights, submit malicious material, attempt to access another user's information, bypass access controls, or disrupt the service. Do not present an Ark output as independently verified, as the opinion of its cited authors, or as a substitute for a clinician's own assessment.

Use is subject to any clearly disclosed account limits. Automated extraction or large-scale use requires prior agreement where it could interfere with availability or another user's access.

7. Sources, outputs and feedback

Articles and other linked material remain subject to their owners' rights and access conditions. Ark's links do not grant permission to reproduce an entire source. Generated text may resemble other outputs and may contain third-party material; check it before sharing or publishing.

You may send voluntary, de-identified feedback or confirmed-case corrections. We may use that feedback to evaluate and improve Ark. Do not include identifiable patient information, third-party confidential material or content you have no permission to share. Providing feedback is not permission to publish your identity or attribute an endorsement to you.

8. Availability and ending access

Beta features, response times and availability may change. We do not promise uninterrupted access or that every requested source, analysis or saved item will always be available. We will explain material changes when reasonably practicable.

We may restrict or suspend access where reasonably necessary to address a security incident, unlawful use, a material breach of these terms or the discontinuation of the beta. Where practicable, we will explain the reason and provide an opportunity to address the issue. Immediate action may be necessary to protect users or comply with law.

You may stop using Ark at any time and contact us to request account closure. Closing an account and deleting personal information are related but separate processes; retention obligations and the limits explained in the Privacy Policy still apply.

9. Your legal rights

Nothing in these terms excludes or restricts a consumer guarantee, remedy or liability that cannot lawfully be excluded or restricted. Where Australian Consumer Law applies, those rights continue to apply to Ark's services. These terms do not require you to release all claims against Ark or waive rights that the law protects.

10. Changes and concerns

The effective date of these terms is 27 September 2026. Material changes will be notified through the service or the account contact details, with renewed acceptance where required. Changes will not retrospectively remove rights or turn free beta access into a paid subscription without your agreement.

For questions, account issues or a complaint, email davidmdtran@gmail.com. We will consider the issue and explain the available next steps. You remain free to use any applicable external complaint or legal process.
